Article 2 : Champ d’application
Les présentes conditions sont applicables à toutes les ventes de produits Oriza L. Legrand réalisées via le site marchand accessible depuis le site Internet www.orizaparfums.com et à destination de tous les pays. Il est précisé que les présentes conditions générales de ventes s’adressent à des particuliers uniquement. La revente ou la distribution des produits Oriza L. Legrand achetés sur www.orizaparfums.com est formellement interdite. Pour toute demande émanant d’un professionnel, contacter le service commercial de Oriza L. Article 3 : Prix
Le prix des articles s'entend en euros, toutes taxes comprises, frais de livraison en sus.
Oriza L. Legrand se réserve le droit de modifier à tout moment et sans préavis les prix des produits proposés sur le site orizaparfums.com. Les produits sont facturés sur la base des tarifs affichés sur le site orizaparfums.com au moment de la validation de votre commande, sous réserve de disponibilité des produits commandés à cet instant.
Toutes les commandes sont payables en Euros uniquement.
Le prix TTC de chacun des articles que souhaiterait acquérir le client, ainsi que le montant des frais de transport afférents à leur livraison lui seront communiqués soit lors de son appel au Service Clientèle de Oriza L. Legrand, soit lors de la connexion au site Internet www.orizaparfums.com.
Conformément aux dispositions de l'article L.121-19 du Code de la consommation, le client recevra, lors de la livraison, pour chacun des articles, la confirmation écrite du prix payé détaillant le prix des articles et les frais de livraison mis à sa charge.
Article 4 : Commande et validation
4.1 Montants maximums de commandeLe montant maximum d’une commande effectuée par un client (même nom, même adresse) ne pourra pas dépasser la somme de 5.000 € toutes taxes comprises (hors frais de livraison).
De même en 7 jours, un client ne pourra passer plus de 3 commandes dont la somme cumulée maximale ne pourra pas dépasser 10.000 € toutes taxes comprises (hors frais de livraison).
4.2 Commandes par InternetLes commandes ne pourront être passées que par Internet sur le site marchand accessible depuis le site Internet www.orizaparfums.com. Le client conserve à sa charge les frais de télécommunication lors de l'accès à Internet et de l'utilisation du site www.orizaparfums.com.
Le client déclare avoir pris connaissance et avoir accepté les présentes conditions générales de vente avant de passer sa commande. La validation de sa commande vaut donc acceptation sans restriction ni réserve des présentes conditions générales de vente.
En cas d'inactivité prolongée lors de la connexion il est possible que la sélection des articles choisis avant cette inactivité ne soit plus garantie. Le client sera invité à reprendre sa sélection de produits depuis le départ.
Toutes les étapes nécessaires à la vente sont précisées sur le site Internet www.orizaparfums.com conformément aux dispositions de l'article 1369-4 du Code civil.
En application des dispositions de l'article 1369-5 du Code civil, le client aura la possibilité, avant de valider définitivement sa commande, de vérifier le détail de sa commande et son prix total, et de corriger d'éventuelles erreurs, avant de confirmer celle-ci pour exprimer son acceptation. A partir du moment où le client a validé sa commande, la société Oriza L. Legrand accusera réception de celle-ci sans délai et par voie électronique, étant précisé que l’accusé de réception de commande ne vaudra en aucun cas confirmation de la disponibilité du ou des produits commandés ni validation du paiement de la commande.
La vente ne sera considérée comme définitive qu'après l'envoi au client de la confirmation de la commande par la société Oriza L. Legrand, précisant l'expédition des articles. Seuls les articles expédiés seront débités avec les frais de transport.
Article 5 : Disponibilité
Les offres de produits et prix sont valables tant qu’ils sont visibles sur le site Internet (www.orizaparfums.com), dans la limite des stocks disponibles. Certaines références, disponibles en quantités limitées, pourraient ne pas être disponibles au moment de la commande. Des indications sont fournies au client lors de la passation de commande. Des erreurs ou des modifications peuvent exceptionnellement exister, notamment dans le cas de commandes simultanées d’un même produit par plusieurs clients.
Le client sera informé de l’indisponibilité éventuelle de ses produits par mail, ou par tout autre moyen de communication (téléphone, fax, etc.) dans les 15 jours et ne pourra en tenir rigueur de quelque manière que ce soit à la société Oriza L. Legrand.
En cas d’indisponibilité de son ou ses produits, le client pourra alors soit choisir dans la gamme un autre article, soit annuler sa commande. Si l’acheteur choisi d’annuler sa commande, il sera immédiatement remboursé si son compte bancaire a déjà été débité et au plus tard dans les 30 jours du paiement des sommes versées par le client.
Article 6 : Informations nominatives
6.1 Commande par Internet
Le client devra, pour pouvoir acheter un produit lors de sa première commande sur le site Internet Oriza L. Legrand, ouvrir un compte client et remplir un formulaire de commande précisant certains champs obligatoires, considérés comme étant des informations nécessaires à la gestion de ladite commande et aux relations commerciales, afin que sa sélection puisse être prise en compte.
6.2 Collecte d’information auprès de mineur de plus de 16 ans
Les mineurs non émancipés n’ont pas la capacité de contracter. La collecte de données auprès de mineurs devra faire l’objet d’une information, par ce dernier, auprès de l’autorité parentale.
6.3 Conservation et Accès aux informations nominatives
Ces données personnelles seront utilisées par la société Oriza L. Legrand Parfums à des fins commerciales, marketing et/ou d’information. Ces informations pourront être communiquées, le cas échéant, à tout tiers contribuant à l’exécution, au traitement et au paiement de la commande.
Afin de respecter les obligations légales et réglementaires et de répondre aux besoins de sa clientèle et assurer un service optimal, la société Oriza L. Legrand Parfums sera amenée à conserver certaines informations concernant le client (coordonnées, etc…). En vertu de la loi n°78-17 relative à l’informatique et aux libertés du 06 janvier 1978, la clientèle de la société Oriza L. Legrand dispose d'un droit d'accès, de modification, de rectification et de suppression des données le concernant. Pour exercer ce droit, le client est invité à adresser un courrier postal au Service Clientèle de Oriza L. Legrand (Adresse ci-dessous) ou un e-mail à contact@orizaparfums.com
En fonction du choix émis par le client lors de la création ou de la consultation de son compte personnel sur Internet, ce dernier sera susceptible de recevoir des informations commerciales et promotionnelles. Si le client ne souhaite plus recevoir de telles informations, il pourra en faire la demande en le précisant dans son compte client ou par e-mail à contact@orizaparfums.com.
Article 7 : Présentation et information sur les produits
Les photographies, graphismes et descriptions des produits proposés à la vente ne sont qu'indicatifs et n'engagent nullement Oriza L. Legrand Parfums. Les clients ont la possibilité d'obtenir des renseignements complémentaires en contactant par téléphone le Service Clientèle de Oriza L. Legrand.
En cas d'erreur manifeste entre les caractéristiques des articles et leur représentation, Oriza L. Legrand ne saurait voir sa responsabilité engagée.
Article 8 : Refus des commandes
Conformément aux dispositions de l'article L.122-1 du Code de la consommation, Oriza L. Legrand sera en droit de refuser toute commande anormale ou passée de mauvaise foi. En outre, Oriza L. Legrand sera en droit de refuser toute commande d'un client avec lequel il existerait un litige relatif au paiement d'une commande antérieure avec Oriza L. Legrand, ou auprès de tout autre commerçant.
Article 9 : Frais de port, livraison et délais
9.1 Les produits sont livrés par La Poste en Colissimo pour la France, L’Europe (C.E.E. + Suisse & Royaume-Uni) et par DHL pour les autres pays.
Colissimo : livraison des articles choisis sous 2 jours ouvrés suivant votre date de commande (pour une validation en ligne effectuée avant 12h, jour ouvré)
DHL: livraison des articles choisis sous 3 à 08 jours ouvrés suivant votre date de commande et le pays de destination (pour une validation en ligne effectuée avant 12h, jour ouvré).

En tout état de cause, en cas de commande vers un pays de non membre de l’Union Européenne, le client est l’importateur des produits concernés. Des droits de douane ou autres taxes locales sont susceptibles d’être exigibles, ces droits de douane sont alors à la charge du client.
Les dépassements des délais de livraison ne peuvent donner lieu à dommages et intérêts.
9.2 La livraison des articles est effectuée à l’adresse indiquée par le client au moment de sa commande (ou avis de mise à disposition en l’absence du client).
Il appartient au client de vérifier l’état de l’emballage ainsi que le contenu des colis lors de la réception de la marchandise et d'émettre des réserves sur le bordereau de livraison si le colis paraît avoir été ouvert ou abîmé. La signature, sans réserve, du récépissé de livraison par le client emportera acceptation de ce dernier.
En aucun cas la société Oriza L. Legrand ne saurait être tenue responsable des dégradations de la qualité des produits et de leur emballage occasionnés par le transport.
9.3 Conformément aux dispositions de l'article L.121-20-3 du Code de la consommation, la livraison des articles commandés interviendra au plus tard dans les 30 jours à compter du jour suivant la commande, sous réserve du paiement complet du prix. Le délai de livraison varie en fonction du type de port et du lieu de livraison. Il court à compter de la réception du règlement ou de l’autorisation bancaire.
Pour toute commande passée par l’intermédiaire du site Internet www.orizaparfums.com, les délais seront indiqués au client lors de sa commande, étant précisé que les délais indiqués sur le site Internet www.orizaparfums.com sont valables pour toute commande passée avant midi (12h00) heure de Paris (GMT +1h00) du lundi au vendredi.
Article 10 : Conditions et modes de paiement
Le règlement des achats du client s'effectue par carte bancaire uniquement : sont acceptées les cartes du réseau "CB", Visa, Eurocard, Mastercard.
Le paiement s’effectue via le serveur de paiement sécurisé de notre partenaire, Banque CIC. Ceci implique qu’aucune information bancaire concernant le Client ne transite via le site. Le paiement par carte bancaire est donc parfaitement sécurisé.
Article 11 : Annulation / Rétractation / Retour / Echanges
11.1 Annulation de commande
Toute demande d’annulation d’une commande doit être effectuée avant l’expédition des produits, pour être prise en considération et au plus tard 24 heures avant la date de départ des colis. Cette annulation devra être effectuée directement auprès du service client de Oriza L. Legrand par téléphone au + 33 (0)1 71 93 02 34 ou par mail à contact@orizaparfums.com.
11.2 Rétractation
En application des dispositions de l'article L.121-20 du Code de la Consommation, le client dispose d'un délai de quatorze jours francs à compter de la livraison de sa commande pour retourner le ou les articles pour échange ou remboursement, au choix du client, sans pénalités à l'exception des frais d'expédition aller (selon lois du pays où se trouve le client) et retour (le retour des produits est systématiquement à la charge intégrale du client). Le client devra informer le service client de Oriza L. Legrand par écrit (courrier, e-mail, par l'intermédiaire de notre formulaire de contact dans la rubrique «Formulaire de rétractation» ci-dessous, fax) de sa décision avant de retourner la marchandise. Les frais de retour seront à la charge du client.
La valeur des produits retournés sera remboursée au client, à réception des produits concernés, ou sur justificatif de la part du client de la preuve d'expédition des produits concernés.
11.3 Retour produits non conformes ou endommagés
Dans l’éventualité où un ou plusieurs produits ne seraient pas conformes à la commande du client ou seraient défectueux, abîmés ou endommagés, le client devra alors informer immédiatement la société Oriza L. Legrand et devra les lui retourner à ses frais et dans un délai de 30 jours à compter de la livraison de sa commande. Le ou les produits de remplacement seront réexpédiés au client au frais de la société Oriza L. Legrand.
Dans l’hypothèse où le ou les produits retournés ne seraient plus disponibles, la société Oriza L. Legrand en informera le client et remboursera le client du montant desdits produits (à l’exclusion de tout frais de transport).

Article 12 : Réserve de propriété
Jusqu’au paiement effectif et intégral du prix, la société Oriza L. Legrand reste propriétaire des biens vendus. Le complet règlement vaudra transfert de propriété, toutefois, le client devient responsable des articles dès la livraison, le transfert de possession valant transfert des risques.
Article 13 : Droit applicable – Litiges

In any case, in case of order to a country of non-member of the European Union, the customer is the importer of the products concerned. Customs duties or other local taxes may be payable, these customs duties are then the responsibility of the customer.
Exceedances of delivery times can not give rise to damages.
9.2 Delivery of items is made to the address indicated by the customer at the time of order (or notice of availability in the absence of the customer).

In application of the provisions of Article L.121-20 of the Consumer Code, the customer has a period of fourteen clear days from the delivery of his order to return the item or items for exchange or refund, at choice of the customer, without penalties except for the cost of shipping from our fabric to your address + return (from your address to our fabric). The customer must inform the customer service of Oriza L. Legrand in writing (mail, e-mail, via our contact form in the "withdrawal form" section below, fax) of his decision before returning the merchandise. The return costs will be borne by the customer.
The value of returned products will be refunded to the customer, upon receipt of the products concerned, or on proof of the customer's proof of shipment of the products concerned.
11.3 Return non-compliant or damaged products
In the event that one or more products are not consistent with the customer's order or are defective, damaged or damaged, the customer must immediately inform the company Oriza L. Legrand and return them at his expense and within 30 days from the delivery of the order. The replacement product (s) will be returned to the customer at the expense of Oriza L. Legrand.
In the event that the returned product or products are no longer available, the company Oriza L. Legrand will inform the customer and refund the customer the amount of said products (excluding any transportation costs).
Article 12: Retention of title
Until the effective and full payment of the price, the company Oriza L. Legrand remains the owner of the goods sold. The complete settlement will be worth transfer of property, however, the customer becomes responsible for the items from the delivery, the transfer of possession being transfer of the risks.
Article 13: Applicable Law - Litigation
13.1 These general conditions of sale are subject to French law.

13.3 If the negotiations fail, the following provisions will apply:
13.3.1 Contract concluded by a French consumer from France: Any dispute arising in connection with the performance or interpretation of this contract shall be brought before the court of the defendant's domicile or place of delivery.
13.3.2 Contract concluded by a consumer placing an order from another country of the European Union: Any dispute arising in the context of the execution or interpretation of this contract shall be brought before the competent courts in accordance with the directives and regulations of the European Union (Brussels Convention, 27 September 1968).
